Federal Court Finalizes Major Win for Premium Cigars

Judge Amit P. Mehta has issued a final order reaffirming that FDA’s Deeming Rule does not apply to premium cigars as defined by the court, closing a major chapter in CRA’s decade-long fight against one-size-fits-all federal regulation.

The Issue

For years, FDA treated premium cigars under the same broad regulatory framework that applied to other tobacco products. CRA and its industry partners challenged that approach in federal court. The courts ultimately vacated FDA’s decision to subject qualifying premium cigars to the deeming rule, and in April 2026 the district court reaffirmed the eight-part definition that determines which cigars qualify as premium cigars.

Why It Matters

The ruling protects qualifying premium cigars from FDA’s deeming-rule requirements and establishes a clear federal definition distinguishing premium cigars from mass-market tobacco products. That gives consumers, retailers, manufacturers, and regulators a more predictable standard.

CRA's Position

CRA supports the court-recognized definition of premium cigars and maintains that these products should continue to be treated separately from mass-market tobacco products under federal regulation. CRA also supports establishing durable statutory protection so the premium-cigar exemption does not depend solely on court decisions or future agency policy.

What CRA Is Doing

Cigar Rights of America led the way in both building the formal record of scientific evidence and investing tens of thousands of hours in advocacy to secure the premium-cigar exemption option that FDA ultimately rejected in the final deeming rule. Both efforts were fundamental to our 2023 victory vacating FDA regulation of premium cigars.

Current Status

The April 15, 2026 district court decision reaffirmed the premium cigar definition. FDA has acknowledged the ruling and is implementing it, including developing a mechanism to stop assessing user fees on qualifying premium cigars.

Judge Metha

After nearly a decade of litigation, a federal court has delivered another major victory for premium cigars, cigar retailers, manufacturers, and adult consumers.

On April 15, 2026, Judge Amit P. Mehta of the U.S. District Court for the District of Columbia issued a final order reaffirming that the U.S. Food and Drug Administration’s Deeming Rule does not apply to premium cigars as defined by the court. The ruling adopts the same premium cigar definition the court previously applied and enters a final order vacating the Deeming Rule as to products covered by that definition.

For Cigar Rights of America, this is more than a legal milestone. It is the result of sustained advocacy, industry engagement, and member support over many years. CRA has long argued that premium cigars are a distinct product category and should not be regulated under a one-size-fits-all framework designed for mass-market tobacco products.

The court’s final order follows years of litigation over FDA’s 2016 decision to bring all cigars under its tobacco regulatory authority. In 2023, Judge Mehta vacated the Deeming Rule as applied to premium cigars, finding FDA’s approach arbitrary and capricious as to that category. In January 2025, the D.C. Circuit affirmed the vacatur of the rule as applied to premium cigars, while sending the case back to the district court for the limited purpose of receiving further briefing on the proper definition of “premium cigars.”

That final question has now been answered. After reviewing the parties’ positions, Judge Mehta declined to alter the definition and entered a final, appealable order vacating the Deeming Rule as it relates to premium cigars.

What the Court Decided

Under the court’s definition, a premium cigar must meet all eight of the following criteria:

  • It must be wrapped in whole tobacco leaf.
  • It must contain a 100 percent leaf tobacco binder.
  • It must contain at least 50 percent long-filler tobacco by weight.
  • It must be handmade or hand rolled.
  • It must have no filter, nontobacco tip, or nontobacco mouthpiece.
  • It must not have a characterizing flavor other than tobacco.
  • It must contain only tobacco, water, and vegetable gum, with no other ingredients or additives.
  • It must weigh more than six pounds per 1,000 units.

Cigars that meet this definition are outside the scope of FDA’s Deeming Rule. Cigars that do not meet the definition remain subject to the rule.

This distinction matters. It preserves regulatory clarity for the traditional premium cigar category while recognizing that handmade premium cigars are different from other tobacco products in how they are made, sold, marketed, and consumed.

Why This Matters

The court’s decision gives the premium cigar community long-needed clarity after years of uncertainty. For manufacturers, it helps preserve the ability to make traditional premium cigars without being forced into a regulatory system that was not built for the category. For retailers, it helps protect the products and businesses their customers rely on. For consumers, it helps defend access to the premium cigars they choose to enjoy responsibly as adults. The ruling also reinforces an important principle: federal agencies must consider the evidence before imposing sweeping regulatory burdens. The D.C. Circuit previously agreed that FDA ignored relevant data and falsely claimed no such evidence existed when it regulated premium cigars under the Deeming Rule.

That principle has been central to CRA’s advocacy from the beginning. Premium cigars are not cigarettes. They are not mass-market tobacco products. They are handmade, artisanal products, sold primarily through adult-oriented channels, supported by small businesses, and sustained by a culture of tradition, craftsmanship, and moderation.

A Victory, Not a Finish Line

This ruling is a major victory, but it does not mean the fight is over.

The court’s order applies to FDA’s Deeming Rule and the premium cigars covered by the court’s definition. It does not prevent future federal rulemaking, and it does not preempt state or local efforts to tax, restrict, ban, or otherwise regulate premium cigars. Legal analysts have noted that stakeholders should continue watching for future FDA action as well as state laws that may impose new requirements on premium cigars.

That is why CRA’s work remains essential.

Even after this win, premium cigars continue to face threats from excessive taxation, flavor and product bans, shipping restrictions, generational tobacco ban proposals, local ordinances, and renewed regulatory pressure. A court victory creates legal clarity, but it does not replace the need for continued advocacy.

CRA’s Role in the Fight

CRA exists to make sure premium cigars have a dedicated national voice. This victory shows why that matters.

For years, CRA has helped keep the premium cigar distinction before regulators, lawmakers, courts, and the public. The outcome in the Mehta litigation reflects the power of sustained engagement and the importance of a united premium cigar community.

This win belongs to everyone who helped fund the fight: CRA members, retailers, manufacturers, industry partners, and adult cigar consumers who refused to let premium cigars be swept into an unjustified regulatory framework without a fight.

The lesson is clear. When cigar consumers and the premium cigar industry are organized, funded, and heard, outcomes can change.

Stand with CRA

The Mehta decision is a landmark victory, but the defense of premium cigars continues in Congress, state capitols, regulatory agencies, city councils, and the courts.

CRA will continue fighting to protect premium cigars as a distinct product category and to defend the rights of adult consumers, retailers, and manufacturers.
